Sellers of California residential real estate have significant duties of disclosure to potential buyers.  Sometimes, sellers breach these duties in their zeal to obtain a ready buyer at the highest possible price.  Real estate brokers are deemed “fiduciaries” under California law, and as such, owe stringent duties of honesty to their principals.  Moreover, brokers must refrain from fraud or dishonest dealing with all parties to a real estate transaction.
